Minimum Requirements for Contracts and Subcontracts:
In order to work on WYDOT projects, all companies are required to have the following in order to be approved for a contract or subcontract:
- Register with Wyoming Secretary of State per Wyoming Statute W.S. 17-4-402 - directions can be found here: https://wyobiz.wyo.gov/Business/RegistrationInstr.aspx
- Register with Wyoming Workforce Services per Wyoming Statute W.S. 27-3-502 - they will issue certificates for both Workers Compensation and Unemployment. Once you register with Wy Workforce Services - if they determine you do not need to report (no employees) they will issue letters that either find you non-liable for coverage or a temporary certificate.
- Certificate of commercial general liability insurance ($1,000,000 per occurrence and $2,000,000 aggregate) and business auto (minimum $500,000 single limit)

- All contractors must be set up with an account in the WYDOT iCX Contract Management System.
Prime Contractor Insurance Requirements:
Provide the following insurance policies meeting the State of Wyoming Statutory requirements, including minimum cancellation notification provisions. Maintain required insurance policies in effect for the duration of the project. Obtain primary, not contributory, policies. File a Certificate of Insurance with the Contracts and Estimates Program in accordance with the Wyoming Standard Specifications for Road and Bridge Construction, Subsection 103.6, Execution and Approval of Contract, verifying each type of coverage; the department’s approval of insurance does not affect the contractor’s liability:
1. Unemployment Insurance - Register and stay registered with the Wyoming Department of Workforce Services for the duration of the contract for Wyoming Unemployment coverege.
2. Workers’ Compensation and Employers’ Liability Insurance - Provide proof of workers’ compensation coverage for every employee who will work on the project. Obtain the coverage through the Wyoming Department of Workforce Services, or current workers’ compensation insurance for out of state contractors, as appropriate.
3. Commercial General Liability Insurance - Provide coverage for the duration of the contract against claims arising out of bodily injury, death, damage to or destruction of the property of others, including loss of use thereof, and products and completed operations, for $1,000,000 per occurrence and $2,000,000 general aggregate. Endorse the policy to include Employees Liability “Stop Gap” coverage, in an amount of at least $500,000 per employee, for each accident, for each disease.
4. Umbrella/Excess Liability Insurance - Maintain for the duration of the contract, and in addition to all other policies, Umbrella/Excess Liability coverage in the amount of at least $1,000,000 per occurrence and $1,000,000 taken together.
5. Business Automobile Liability Insurance - Maintain for the duration of the contract, automobile liability insurance for claims arising out of the use of an automobile, including owned and non-owned automobiles for at least $500,000 combined single limit.
